The rules
New York dispensary rules, in plain English.
Who can buy, how much you can carry, when NYC shops can sell, how delivery works and where you can use it. This is the short version for your shop trip, not legal advice.

Who can buy
Adults 21 and older can buy adult-use cannabis at licensed dispensaries. Staff check ID before every sale. A New York license or non-driver ID, another government photo ID, IDNYC, a passport, a consular ID or a military ID all work. Delivery drivers check ID again at the door.
Possession limits
| Where | Limit |
|---|---|
| Carrying | Up to 3 ounces of cannabis |
| Carrying | Up to 24 grams of concentrated cannabis |
| At home | Up to 5 pounds, kept secure |
Shops cannot sell you more in a day than the possession limit, and a shop can set a lower limit of its own.
Where you can use it
State law bans smoking and vaping cannabis anywhere tobacco smoking is banned under the Clean Indoor Air Act. That includes workplaces, restaurants and bars, and within 100 feet of school and public library entrances. Using cannabis in any form on school grounds or a school bus is banned.
New York City goes further. The Smoke-Free Air Act applies to cannabis and covers parks, beaches, boardwalks, playgrounds, pedestrian plazas, public golf courses, stadiums, outdoor dining, transit and common areas of buildings with three or more units. State parks are smoke-free too, and so is federal property.
Landlords and hotels can ban smoking and vaping on their property. In NYC they cannot ban edibles or legal possession inside your home. NYCHA bans smoking and vaping cannabis, and federal law bans cannabis in federally funded housing.
Shop hours and delivery
Dispensaries in New York City cannot sell between 2 AM and 8 AM. Each shop picks its own hours inside that window.
Licensed dispensaries can deliver. Delivery is prepaid, it runs during the shop's hours, it has to go to a New York address that is not a public place, school or vehicle, and the driver checks your ID at the door.
Leaving New York
It is illegal to take cannabis into or out of New York, even to another state where it is legal. Adult-use cannabis is still illegal under federal law, so do not pack it for a flight. Federal property follows federal law too.
